Terms Of Service

Effective Date: February 23, 2026

1. Acceptance of Terms

These Terms of Service govern your use of the Histora Lens mobile application and related services operated under the Aryber brand. By accessing or using the service, you agree to these Terms.

If you do not agree, do not use the service.

You must have legal capacity under applicable law to accept these Terms. If you are below the applicable digital age of consent in your country, parental or legal guardian approval is required.

4. Service Description

Histora Lens may include, without limitation:

  • Artifact identification via image scan

  • Nearby location discovery

  • Personal collection/history features

  • Audio guide generation

  • Notification delivery

  • Credit and premium entitlement features

Features may vary by device, region, language, platform policy, and service availability.

5. Account and Device Responsibilities

You are responsible for:

  • Keeping access to your device and accounts secure

  • Providing accurate information when you choose to submit profile data

  • Lawful use of social sign-in accounts used to access the service

You must not attempt to access another user’s account, token, or data.

6. Credits, Ads, Premium, and Purchases

6.1 Credits and Fair Use

Some features consume credits or are subject to fair-use controls (for example scan/audio requests and premium abuse prevention thresholds).

6.2 Ad Rewards

Ad reward eligibility, limits, and verification rules may apply. Daily or operational limits may restrict reward grants.

6.3 Premium and Billing

In-app purchases and subscriptions are processed by your app store billing platform and related processors (including Adapty integration for entitlement management). Prices, taxes, and billing terms are shown in purchase interfaces.

6.4 Refunds and Restores

Refund and restore behavior is governed by platform and store rules, subject to local mandatory consumer law.

7. Acceptable Use

You agree not to:

  • Upload unlawful, infringing, or malicious content

  • Interfere with service integrity, security, or availability

  • Reverse engineer, scrape, or abuse APIs beyond allowed use

  • Attempt to bypass rate limits, credits logic, or entitlement controls

  • Use automated methods to exploit or overload the service

We may investigate abuse and take proportionate technical and legal action.

8. User Content and Limited License

You retain rights in content you submit, to the extent allowed by law. You grant us a limited, non-exclusive, worldwide license to process submitted content solely to operate, secure, and improve the service (including scan processing, caching, and related outputs).

9. AI and Informational Output Disclaimer

Histora Lens may provide AI-generated outputs (including artifact metadata and audio narration). Such outputs are for informational purposes, may contain inaccuracies, and are not professional legal, medical, financial, or safety advice.

You remain responsible for decisions made using service outputs.

10. Third-Party Services

The service depends on third-party providers (for example authentication, notifications, analytics/diagnostics, payments/entitlements, ads, AI, and TTS). Availability or behavior of these providers can affect service performance.

11. Suspension and Termination

We may suspend, limit, or terminate access where reasonably necessary, including for:

  • Security risks

  • Suspected abuse/fraud

  • Material Terms violations

  • Legal or regulatory obligations

You may stop using the service at any time and may request account deletion from within the app where available.

12. Availability and Changes

The service is provided on an "as available" basis. We may modify, replace, or discontinue features at any time, including usage limits and monetization mechanics, provided mandatory legal rights are respected.

13. Intellectual Property

All software, branding, and service materials (excluding your own content) are owned by Aryber or its licensors and protected by applicable intellectual property laws.

No license is granted except as expressly stated in these Terms.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The service is provided without guarantees of uninterrupted, error-free operation

  • We are not liable for indirect, incidental, special, consequential, or punitive damages

  • Our liability is limited to the extent permitted by mandatory law

Nothing in these Terms excludes rights that cannot be waived under applicable consumer or data-protection law.

15. Governing Law (Neutral Clause)

These Terms are interpreted under applicable law rules that cannot be excluded by contract, including mandatory consumer protection provisions. This clause does not remove rights granted to you by mandatory law in your country of residence.

16. Privacy

Use of the service is also governed by the Histora Lens Privacy Policy, which explains how personal data is processed, including KVKK and GDPR sections.

17. Changes to These Terms

We may update these Terms over time. Updated Terms become effective on the stated effective date. Continued use after that date means you accept the updated Terms, subject to your non-waivable legal rights.
